FreeStyle Libre

FreeStyle Libre systems are sensor-based continuous glucose monitors (GCMs) which allow users to track their glucose levels without finger sticks. FreeStyle Libre is a brand of Abbott U.S, specifically Abbott Diabetes Care.

HIPAA, Privacy Policy, and Data Collection

Unlike most of the healthtech products covered in the Your Healthtech Database, Freestyle Libre is a hybrid entity under HIPAA, meaning that it is a single legal entity that includes both HIPAA-regulated and non-HIPAA activities.

Only the information that Abbott Diabetes Care creates or receives is related to HIPAA and its privacy policy. This includes: information that you share with your healthcare provider, information that ADC receives from your healthcare provider, information used to investigate your health plan benefits, information your health plan benefits relating to the FreeStyle Libre system, information used to support your healthcare providers who use the LibreView system, and more.

Data Sharing

Your data can be used and share for: treatment in analyzing and evaluating your glucose data and test results and your ketone test rules; obtainment of reimbursement from health plans and other entities for health care services; and health care operations including business planning and development and cloud storage.

It may also be used for the purposes of public health and safety, research, law compliance, response to organ and tissue donation requests from organ procurement organizations, medical examiners or funeral directors, workers’ compensation, law enforcement, government requests, lawsuits and legal actions, and more.

Privacy Rights

For “certain health information,” users have the choice to determine what Freestyle Libre shares. For example, you have the right and choice to determine how to share information with your friends and family involved in your care or in a disaster relief situation and whether to include your information in a hospital directory.

If you are not able to communicate your preference for example due to being unconscious, FreeStyle Libre may “go ahead and share your information if [they] believe it is your best interest” or to “lessen a serious and imminent threat to health or safety.”
